By accessing or using any part of our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you may not access or use our services. Use of our services is limited to individuals who are 21 years of age or older. Age verification may be required.

8. USER GENERATED CONTRIBUTIONS (UGC)

You may be able to post reviews, comments, or other content on our platform (collectively, "Contributions"). By submitting any Contribution, you grant Innerbloom a worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, publish, translate, distribute, and display such content.

You represent and warrant that:

• You own or control all rights to your Contributions.
• Your Contributions do not infringe any third-party rights or violate any laws.
• Your Contributions are not false, defamatory, obscene, or misleading.

We reserve the right to monitor, edit, or remove any Contributions at our discretion.

9. CONTRIBUTION LICENSE

By posting UGC on our website, you acknowledge and agree that Innerbloom has the right to use such content in any manner we see fit, including for advertising, marketing, or promotional purposes. You waive all moral rights to such content and acknowledge that Innerbloom is not responsible for user content posted by others.

10. SERVICES MANAGEMENT

We reserve the right to:

• Monitor the services for violations of these Terms.
• Take legal action against violators.
• Refuse service to any user for any reason.
• Remove or disable content or features that threaten the integrity of our services.

11. TERM AND TERMINATION

These Terms remain in effect while you use our services. We may suspend or terminate your access at any time without notice if you breach these Terms, including but not limited to violations of user conduct, false verification, or misuse of the platform.

If terminated, you may not create a new account or access the services through another user.

12. MODIFICATIONS AND INTERRUPTIONS

We may modify, suspend, or discontinue any part of our services at any time without notice. We are not liable for any loss or inconvenience caused by such changes. We do not guarantee uninterrupted access to our services.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

14. DISPUTE RESOLUTION

Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You waive any objections to venue or jurisdiction.

15. CORRECTIONS

We may correct errors, inaccuracies, or omissions at any time and without prior notice. This includes errors in pricing, descriptions, or availability.

16. DISCLAIMER

Our services are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that our services will be error-free, uninterrupted, or free of harmful components. Your use is at your sole risk.

17. LIMITATIONS OF LIABILITY

To the fullest extent permitted by law, Innerbloom shall not be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or related to your use of the services or products.

18. INDEMNIFICATION

You agree to indemnify and hold Innerbloom and its affiliates harmless from any claims, damages, liabilities, and expenses arising out of:

• Your use of the services;
• Your violation of these Terms;
• Any user content submitted by you;
• Your violation of any law or third-party rights.

19. USER DATA

While we perform regular backups, we are not responsible for any loss of data. You agree to back up your content and data, and you release us from liability for data loss.

20. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

You consent to receive electronic communications and agree that such communications meet legal requirements for written communication. You agree to electronic signatures, contracts, orders, and other records.

22. MISCELLANEOUS

These Terms and any other policies posted by us constitute the entire agreement between you and us. Our failure to enforce any right shall not waive that right. If any provision is found unenforceable, the remainder of the Terms will remain in full effect.

23. PROMO/DISCOUNT CODE USAGE

Promo codes are limited to one per order, non-transferable, and not applicable to bundles or sale items unless explicitly stated. Misuse may result in cancellation and account suspension. We reserve the right to modify or discontinue codes at any time.

24. AUTO-DELIVERY PLANS

By enrolling in an Auto-Delivery Plan (also referred to as a “subscription”), you authorize Innerbloom to automatically charge your saved payment method at the frequency you selected (e.g., every 2 weeks, monthly). You will receive the selected products on a recurring basis until you pause or cancel the plan.

You are responsible for ensuring your payment details remain up-to-date. In the event of a failed payment, our system will automatically retry billing up to three times, with one attempt per day. If all three attempts fail, your Auto-Delivery Plan will be paused. You may resume your plan by updating your payment method.

Auto-Delivery Plan participants will receive a discount at sign-up, and an increased discount after a certain amount of months. No free trials are offered. Auto-Delivery discounts apply only to eligible products and exclude promotional bundles, limited-time offers, gift sets, or sale items, unless explicitly stated.

You may cancel your Auto-Delivery Plan at any time. However, to change the quantity or product type, you must cancel the existing plan and start a new one to ensure correct billing and discount application.

25. PRE-ORDERS

Pre-ordering a product means purchasing an item not currently in stock or scheduled for future release. Pre-orders may require full or partial payment at checkout, with the remaining balance charged when inventory becomes available.

Estimated shipping timeframes for pre-ordered items are displayed on the product page. If your order contains both in-stock and pre-order items, it may be held or split depending on fulfillment logistics.

Pre-orders can be canceled at any time prior to fulfillment. Once a pre-order has been fulfilled and shipped, it cannot be canceled or modified, though it may be eligible for a return in accordance with our standard return policy.

We reserve the right to delay, cancel, or modify pre-orders based on supply chain issues, production delays, or regulatory concerns.

26. ACCOUNT ABUSE AND CIRCUMVENTION

Innerbloom reserves the right to permanently suspend, ban, or terminate any customer account for violations of these Terms of Service, including but not limited to abusive behavior, fraudulent activity, or repeated policy violations. Customers who are banned from using our Services are expressly prohibited from creating new accounts under a different name, email address, mailing address, or payment method, whether personally or on behalf of another individual or entity.

Any attempt to circumvent a prior ban or suspension—whether directly or indirectly—constitutes a material breach of this agreement. Innerbloom reserves the right to cancel any orders, withhold or deny refunds, and take legal action, including but not limited to seeking damages and injunctive relief, against users found to be engaging in circumvention tactics.

We actively monitor account creation and usage. If a banned user is found to be using the Services through an alias, proxy, or another user’s account, that account may also be suspended without notice.

27. AGE VERIFICATION

To comply with federal and state laws and ensure a safe shopping experience, Innerbloom utilizes a third-party age verification service (AgeChecker.net) to verify the legal age of customers purchasing regulated products. You agree to submit valid and accurate identification documents as requested.

We reserve the right to deny service, cancel orders, and permanently block accounts that fail or are denied age verification, regardless of subsequent attempts. If you fail to verify your age within 72 hours of your order or if your verification is denied for any reason, your order will be canceled and refunded. Repeat age verification failures or suspicious activity related to identity misrepresentation may result in permanent account termination and a ban from accessing our Services.

Innerbloom also reserves the right to retain or share information with AgeChecker.net to facilitate future compliance checks. Successful age verification does not waive our right to refuse service under any other part of these Terms of Service.
